Is The Copy of Software with the CMM Legal?

The used equipment market for CMMs is rife with risk, as our article on "Ways to buy a used CMM" shows.  One additional risk that deserves special attention is the legal liability of recieving software with the machine that is in violation of the End User License Agreement (or EULA).  CMM machines sold on the used market, regardless of the brand, are often in technical default of the software license agreement.  Most software these days is licensed to the end user, not sold.  This means that your company has purchased the right to use the software from the developer as long as the company owns it, but in most cases it does not automatically confer the right to re-sell the software, even if the sofware is sold with the machine it came with.  This is because the person/company the equipment is sold to has not accepted the license agreement with the software developer.   However, many EULA's allow for a transfer of the license under certain circumstances, but they must be followed for the buyer of the used equipment to be clean and legal.

For example, the PC-DMIS EULA allows a transfer under certain circumstances, but requires that the seller of the software notify Hexagon Metrology if they wish to transfer to license of software to a new owner (as in selling the machine to someone else).
